Overview

Effective September 1, 2025:

Sociavis creates technologies and services that help people connect with each other, develop communities, and grow businesses. These Terms of Service (the "Terms") govern your access to and use of Sociavis and the other products, websites, features, apps, services, technologies, and software we offer (the Sociavis Products or Products), unless we expressly state that separate terms (and not this one) apply. If we show you ads on Sociavis products, these Terms also apply to how Sociavis uses information to show you ads that companies and organizations pay us to promote. These Products are provided to you by Sociavis. These Terms therefore constitute an agreement between you and Sociavis. If you do not agree to these Terms, you may not access or use Sociavis or the other products and services covered by these Terms.

These Terms (formerly known as the Statement of Rights and Responsibilities) constitute the entire agreement between you and Sociavis with respect to your use of our Products. These Terms take precedence over any previous agreements.

Our Products allow you to connect with your friends and communities and to receive personalized content and advertising (if we show you ads on Sociavis Products) that we believe will be relevant to you and your interests.

If you use our Products for free with ads, we will not charge you for the use of our Products and services to which these Terms apply, unless we state otherwise. Instead, companies, organizations, and other individuals pay us to show you ads for their products and services. We'll show you ads that we think will be relevant to you, and we'll use your data to determine which ads to show you. You can also subscribe to use our Ad-Free Products. Please see Section 2 below for more information on how advertising works in the Sociavis Products.

Our Privacy Policy explains how we collect and use your information, including to control what ads to show you if you choose to use our Products with ads for free and to provide the Sociavis Products described below. You can also check the Settings page of the relevant Sociavis product at any time to see what privacy choices you have about how we use your data.

 

 

 

Which products are covered by these Terms?

 

1. The services we offer

Our mission is to empower people to build community and bring the world closer together. We provide the Products described below to you to accomplish this mission:

1.1 Offering, personalizing and improving our Products:

Your experience on Sociavis is unique to you and different from others: from the posts, stories, events, ads (if we show you ads on Sociavis products) and other content you see in the Sociavis feed or on our video platform, to the Sociavis pages you follow and the other features you may use, such as Sociavis Marketplace and search. For example, we use information about the connections you make, the choices and settings you select, and what you share and do on and off our Products to personalize your experience.

We help you find and connect with people, groups, companies, organizations, and others that matter to you in the Sociavis Products you use, and (if you choose to connect with people on Third-Party Products) third-party products. We use the information we have to make suggestions to you, such as groups to join, events to attend, Sociavis Pages to follow or message, series to watch and people you may want to be friends with. A stronger connection makes for better communities, and we believe that our Products are most useful when people connect with people, groups, and organizations that care about them. We want the content and suggestions you see on Sociavis to be as interesting and valuable to you as possible. Refer to our recommendation system cards to learn how our different recommendation systems prioritize signals to determine what content and suggestions you see, as well as the options to customize your experience.

To help you discover content, products, and services that are important to you, we show you personalized ads, offers, and other sponsored or commercial content to help you discover content, products, and services offered by the many companies and organizations that use Sociavis and other Sociavis products.

This is further explained in Article 2 below.

Our Products offer many ways to express yourself or communicate with friends, family, and others about what matters to you, for example, by sharing status updates, photos, videos, and stories in the Sociavis Products (in accordance with your settings), by sending chat messages to or participating in voice calls or video calls with a friend or multiple people,  by creating events or groups, or by adding content to your profile or showing insights about how others are responding to your content. We've also developed, and continue to explore, new ways for people to use technology, such as augmented reality and 360-degree videos, to create and share more engaging and interactive content on Sociavis products.

We conduct research to develop, test and improve our Products. This includes analyzing information we have about our users and understanding how people use our Products, such as by conducting surveys and tests and troubleshooting new features. We use and develop advanced technologies, such as artificial intelligence, machine learning systems, and augmented reality, to help people use our Products safely, regardless of their physical ability or geographic location. For example, such technology helps people with visual impairments understand what or who is in a photo or video shared on Sociavis. We're also building advanced network and communications technology to help more people get an internet connection in areas with limited access. And we're building automated systems to better protect our community and our Products.

1.2 Promoting the safety, security, and integrity of our Products, combating harmful behavior, and keeping our user community safe:

people will only build a community in Sociavis products if they feel safe and secure. We do our best to maintain the security (including the availability, authenticity, integrity, and confidentiality) of our Products and services. We employ dedicated teams around the world, work with third-party service providers, partners, and other relevant entities, and develop advanced technical systems to detect potential misuse of our Products and harmful behavior toward others, and to discover situations where we may be able to support or protect our community, including responding to user reports about the potential content violation. When we become aware of such content or behavior, we will take appropriate action, which may include sending you a notification, offering assistance, removing or restricting content, revoking or restricting access to certain features, disabling an account, or contacting law enforcement. We share information with other Sociavis companies when we detect abusive or harmful behavior by someone using one of our Products or to help keep Sociavis Products and users and the community safe. For example, we share information with Sociavis companies that provide financial products and services to help them promote safety, security, and integrity and comply with applicable laws. Sociavis may access, secure, use, and share any information that Sociavis collects about you when Sociavis has a good faith belief that doing so is required or permitted by law. In some cases, the Supervisory Committee may review our decisions, depending on its conditions and house rules. You can find more information here.

1.3 Provide consistent and frictionless experiences across all Sociavis Company Products, outside of our contract with you:

we design our systems so that your experience is consistent and hassle-free across the different Sociavis Company Products you use, depending on your choices. For example, we use information about people you interact with on Sociavis to make it easier for you to get in touch with them in The Messenger feature, and we allow you to communicate with a company you follow on Sociavis through The Messenger feature.

1.4 Communicating with you:

There may be times when we need to send you communications, such as emails or notices in a product, to respond to you or inform you about product-related issues, research, or our terms and policies. Please read our Privacy Policy for more information.

1.5 Guaranteeing access to our Products:

To operate our global services and enable you to interact with people around the world, we need to transfer, store and distribute content and data to our data centers, partners, service providers, suppliers and systems around the world, including outside your country of residence. The use of this global infrastructure is necessary and essential to deliver our Products. This infrastructure may be owned, operated or controlled by Sociavis, Sociavis, or its affiliated companies. Please see our Privacy Policy for more information about how we transfer, store or process your information.

2. How our services are funded

You can choose to use our Products for free with ads or subscribe to ad-free use:

                     If you choose to use our Products for free with ads, you give us permission to show you ads that companies and organizations pay us to promote on and off the Sociavis Products.

                     If you choose to subscribe to the use of our Ad-Free Products, you will not see any ads from us and we will not use your data for advertising. The details about the price, currency, and payment period for the ad-free plan will be provided to you before you complete your purchase.

Protecting people's privacy is central to the way we've designed our advertising system. When we show you ads on Sociavis products, we show you relevant and useful ads without telling advertisers who you are. We don't sell your personal information, and we don't share information with advertisers that directly identifies you (such as your name, email address, or other contact information) unless you specifically give us permission to do so. Instead, we allow advertisers to tell us things like their business goal and the type of audience they want to show their ads to (such as people between the ages of 18 and 35 who live near the advertiser's store in the United States). We then show their ad to people who we think might find it relevant.

We also provide advertisers with reports on the performance of their ads to help them understand how people interact with their content both on and off Sociavis products. For example, we provide advertisers with general demographic and interest information to help them better understand their target audience (for example, they know that an ad has been viewed by a woman between the ages of 25 and 34 who lives in Brussels and is interested in software engineering). We do not share any information that directly identifies you (such as your name or email address that can be used to contact you or determine who you are) unless you give us specific permission to do so. 3. Your commitments to Sociavis and to our community

We provide these services to you and others to further our mission. In return, you need to make the following commitments:

3.1 Who can use Sociavis

When people stand behind their opinions and actions, our community is safer and more accountable. For this reason, you must comply with the following:

                     Give your account the same name as the name you use in everyday life;

                     Provide accurate information about yourself;

                     Create only one account (your own) and use it for personal purposes;

                     Don't share your password, give others access to your Sociavis account, or transfer your account to anyone else (without our permission).

We're working to make Sociavis generally available to everyone, but you won't be able to use Sociavis if:

                     You are under 13 years old.

                     You are a convicted sex offender.

                     If we've previously disabled your account for violating our Terms, the Community Standards, or other terms and other policies applicable to your use of Sociavis. If we deactivate your account for a violation of our Terms, Community Standards, or other terms and policies, you agree not to create another account without our permission. If you obtain permission to create a new account at our sole discretion. This does not mean or imply that the disciplinary measure was wrong or without cause.

                     If you are not allowed to receive our products, services, or software under applicable law.

3.2 What you can share and do in Sociavis products

We want people to use Sociavis products to express themselves and share content that they care about, but this shouldn't come at the expense of the safety and well-being of others or the integrity of our community. Therefore, you agree that you will not engage in any of the behaviors described below (nor assist or support others in doing so):

1.                   You may not use our Products to do or share:

                     violate or attempt to circumvent these Terms, the Community Standards, and any other terms and policies that apply to your use of our Products;

                     that is unlawful, misleading, discriminatory or fraudulent (or helps anyone else to use our Products in such a way);

                     that you do not own or have the necessary rights to share;

                     that infringes or violates the rights of others, including their intellectual property rights (such as infringement of someone's copyright or trademark, or the distribution or sale of counterfeit or pirated goods), unless an exception or limitation applies under applicable law.

2.                   You may not upload any viruses or malicious code, use the services to send spam, or do anything else that may disable, overburden, disrupt, or interfere with the proper functioning, integrity, performance, or proper display of our services, systems, or Products.

3.                   You must not collect or access any data from our Products using automated means (without our prior consent) or attempt to access any data that you are not authorised to access. This is true whether or not such automated access or collection takes place while you are logged into a Sociavis account. We also reserve all our rights against text and data mining.

4.                   You may not proxy, request or collect any Product usernames or passwords, or misuse access tokens.

5.                   Except as provided in the Platform Terms, you may not sell, license, or buy any data obtained from us or our service, whether or not it was obtained while logged into a Sociavis account.

6.                   You may not abuse any reporting, reporting, dispute, or appeal channel, such as by submitting fraudulent, duplicate, or unfounded reports or appeals. 7.                   You may not do, or attempt to do, circumvent, avoid, or disregard any technological measures used by Sociavis to control or restrict access to our Products or data.

Content that violates these provisions may be removed, blocked or restricted by us. We may also suspend or disable your account for conduct that violates these provisions, as provided in Section 4.2.

If we remove, block, or restrict content that you share because you've violated the Community Standards, we'll notify you and explain your options for requesting another review, unless you've severely or repeatedly violated these Terms, or expose ourselves or others to legal liability.  harm our community of users, jeopardize or disrupt the integrity or operation of any of our services, systems or Products, when we are restricted due to technical limitations or if we are not permitted to do so for legal reasons. Please see Section 4.2 below for information on account suspension or termination.

We work with independent fact-checkers in many jurisdictions to combat disinformation. When content has been reviewed by fact-checkers, we may add a note to provide additional context. More information about fact-checking can be found here.

To support our community, we encourage you to report content and behaviors that you believe infringe your rights (including intellectual property rights) or our terms and policies, if this feature exists in your jurisdiction.

We may also remove, block, or limit access to content, features, services, or information if we determine that doing so is reasonably necessary to prevent or mitigate misuse of our services or adverse legal or regulatory consequences to Sociavis.

3.3 The consents you grant us

We need certain permissions from you to provide our services:

1. Your content: Some of the content you share or upload, such as photos or videos, may be protected by intellectual property laws.

You own the content you create and share on Sociavis and in other Sociavis Company Products that you use, and nothing in these Terms takes away the rights you have in your own content. You are free to share your content with anyone, anywhere.

However, you will need to give us some legal permissions (also known as a "license") to use that content in order for us to provide our services. This is solely for the purpose of providing and improving our Products and services described in Section 1 above.

2. Permission to Use the Content You Create and Share: Specifically, when you share, post or upload content that is subject to intellectual property rights on or in connection with our Products, you grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to host, use, distribute your Content,  adapt, perform, copy, publicly display or display, translate, and create derivative works (in accordance with your privacy and app settings). This means, for example, that when you share a photo on Sociavis, you give us permission to store, copy, and share that photo with others (in accordance with your settings, of course), such as Sociavis products or service providers that support those products and services. This license will terminate when your content is removed from our systems.

3. Delete your content: You can delete individual content that you share, post, or upload at any time. In addition, all content posted to your personal account will be deleted if you delete your account. Learn how to delete your account. Account deletion doesn't automatically delete content you post from a Page's admin role or content you co-create with other users, such as photos in Shared Albums that may remain visible to other album members.

It can take up to 90 days to remove content after we begin the account deletion process or receive a request for removal of content. If you send content to the trash, the deletion process will automatically begin within 30 days, unless you choose to delete the content sooner. While the removal process for such content is ongoing, the content will no longer be visible to other users. After the content is deleted, it may take us up to 90 days to remove it from backup and disaster recovery systems.

Content will not be removed within 90 days of the account or content deletion process beginning if:

                     if your content has been used by others in accordance with this license and they have not removed the content (in which case this license will continue until that content is removed);

                     if deletion within 90 days is not possible due to technical limitations of our systems. In this case, we will complete the deletion as soon as technically possible; or

                     if immediate removal would limit our ability to:

                     investigate or detect illegal activity or violation of our terms and policies (for example, to identify and investigate misuse of our Products or systems);

                     protect the safety, integrity, and security of our Products, systems, services, and users, and defend ourselves;

                     comply with legal evidence retention obligations, including records retained by Sociavis companies that provide financial products and services, in order to comply with all legal record-keeping obligations; or

                     comply with a request from a judicial, administrative, enforcement or public authority,

In this case, the content will not be kept longer than necessary for the purposes for which it is stored (the exact duration will vary from case to case).

In each of the above cases, the license will remain in effect until the content is completely removed.

4. Permission to use your name, profile picture, and information about your actions with ads (if we show you ads on Sociavis Products) and sponsored or commercial content: Your name, profile picture, and information about actions you have taken on Sociavis may be used in addition to or in connection with ads, offers, and other sponsored or commercial content that we display in our Products,  without us owing you any compensation. For example, we may show your friends that you're interested in an advertised event or that you'd like a Sociavis Page created by a brand that has paid us to run its ads on Sociavis. Ads and content like these can only be seen by people you've given permission to see your actions on Sociavis products. Learn more about your ad settings and preferences here.

5. Permission to update software you use or download: If you download or use our software, you authorize us to download and install updates to the software, where available.

3.4 Restrictions on the use of our intellectual property

If you use content that is subject to intellectual property rights that we hold and make available in our Products (such as images, designs, videos, or sounds that we provide and that you add to content that you create or share on Sociavis), we retain all rights to that content (excluding your rights). You may only use our copyrights, trademarks (or similar marks) when expressly permitted by our Brand Usage Guidelines or with our prior written consent. You must obtain our written permission (or permission under an open source license) to modify, translate, create derivative works of, decompile, reverse engineer, or otherwise attempt to extract the source code from us of our products or their components, unless an exception or limitation applies under applicable law or your conduct is related to Sociavis' bug bounty program. We reserve all rights not expressly granted to you.

 

 

4. Additional provisions

4.1 Updating our Terms

We're constantly improving our services and developing new features to improve our Products for you and our community. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices, to promote a safe and secure experience with our Products and services, and/or to comply with applicable law. Changes will only be made if the provisions are no longer appropriate or if they are not complete and only if the changes are reasonable and take due account of your interests or if the changes are required for safety and security purposes or to comply with applicable law.

Unless the changes are required by law, we will notify you (for example, by email or through our Products) at least 30 days before we make any changes to these Terms and give you a chance to review the changes before they take effect. Once the updated Terms go into effect, you will be bound by these Terms if you continue to access or use our Products.

We hope that you will continue to use our Products, but if you do not agree to our updated Terms, or wish to terminate your agreement to this agreement, you may delete your account at any time and you should also stop accessing or using Sociavis and the other Sociavis Products.

4.2 Account Suspension or Termination

We want Sociavis to be a place where people feel welcome and safe to express themselves and to share their thoughts and ideas.

If we determine that you have a clear, serious, or repeated violation of our Terms or Policies as set forth in Section 5, including in particular the Community Guidelines that detail what content is not allowed on Sociavis Company Products, we may suspend or permanently disable your access to Sociavis Company Products,  and we may permanently disable or delete your account. We may also disable or delete your account if you repeatedly infringe other people's intellectual property rights or if we are required to do so for legal reasons. We may disable or delete your account if your account has not been confirmed after registration, your account is unused and remains inactive for an extended period of time, or if we discover that someone has used your account without your permission and we are unable to confirm your ownership of the account. In general, we will notify you in advance and give you the opportunity to remedy the infringement(s) in question. However, no prior notice and/or opportunity to remedy the breach will be given if the severity of the breach requires immediate termination of your access to the Sociavis Company Products or if it is impossible to remedy the breach. In addition, when we disable or delete your account, we will explain what options you have to request another review, unless doing so exposes ourselves or others to legal liability, harms our community of users, jeopardizes or disrupts the integrity or operation of our services, systems, or Products, if there are technical limitations, or if we are not allowed to do so for legal reasons. If you delete your account or we disable or delete your account, and you stop accessing or using Sociavis and the other Sociavis Products, or if this agreement is otherwise terminated, these Terms will terminate as an agreement between you and us, except for the following provisions, which will survive:  (3, 4.2-4.5).

4.3 Limitations of liability

Nothing in these Terms is intended to exclude or limit our liability in the event of death, personal injury or fraudulent misrepresentation resulting from our negligence, nor to affect your statutory rights.

We take professional care in providing our Products and services to you and in maintaining a safe, secure, and error-free environment. Provided that we have acted with professional care, we accept no liability for losses not caused by a breach of these Terms by us or otherwise by our actions, losses that are not reasonably foreseeable by you and us at the time we entered into these Terms, and events that occur beyond our reasonable control.

4.4 Disputes

If any claim or dispute arises out of or in connection with your use of the Sociavis Products as a consumer, you and we agree that you may bring your own claim or dispute against us, and that we may bring our claim or dispute against you, in any court of competent jurisdiction in the country of your primary residence that has jurisdiction over your claim or dispute,  and the laws of that country shall apply regardless of any rules on conflict of law provisions.

If any claim or dispute arises between us that relates to the use of the Sociavis Products in any other capacity, including, but not limited to, access or use of the Sociavis Products for any business or commercial purpose, or that an entity brings on your behalf, you agree that such claim or dispute must be resolved in a court of competent jurisdiction located in the Netherlands and the laws of the Netherlands applies to any such claim or dispute, regardless of any conflict of law rules.

4.5 Miscellaneous

1.                   Additional Terms: Some of the Products we offer are also subject to additional terms and conditions. If you use any of these Products, you will have the opportunity to agree to the additional terms and conditions that will form part of our agreement with you. For example, if you visit or use our Products for commercial or business purposes, such as buying ads, selling products, developing apps, or managing a group or Page for your business, or if you use our measurement services, you must agree to our Commercial Terms. If you post or share content with music, you must comply with our Music Guidelines. If you're on a no ads subscription, the no ads terms also apply. If you use Avatars, the Avatar Terms also apply. If you use our AI products and features, the Sociavis AI Terms also apply. To the extent that any additional terms conflict with these Terms, the additional terms and conditions shall prevail with respect to the conflict.

2.                   Severability: If any part of these Terms is found to be unenforceable, the unenforceable part shall be deemed modified to the minimum extent necessary to make it enforceable, and if it is unenforceable, it shall be severed and the remainder shall remain in full force and effect. If we fail to enforce any of these Terms, we are not waiving our rights. Any amendment or waiver of these Terms must be in writing and signed by us.

3.                   No Assignment: You will not transfer any rights or obligations under these Terms to anyone else without our consent.

4.                   Legacy contacts: You can designate someone (we'll call them the legacy contact) to manage your account if it's memorialized. If you enable it in your settings, only the legacy contact or a person you designate in a valid will or similar legal document that clearly shows permission to disclose your content to that person after death or inability can request limited disclosure of information from your account after it is memorialized.

5.                   No Third Party Beneficiaries: These Terms do not confer any rights on behalf of third parties. All of our rights and obligations under these Terms are freely assignable in the event of a merger, acquisition, or sale of assets, whether by law or otherwise.

6.                   Changing username: In some cases, we may need to change the username on your account (for example, if someone else claims the username and it doesn't appear to be related to the name you use in everyday life).

7.                   Feedback: We always welcome feedback and other suggestions about our products and services. However, we may use feedback and other suggestions without restriction and without obligation to compensate you for them, and we are not obligated to keep them confidential.

                     Community Standards: These guidelines outline our standards regarding the content you post on Sociavis and your activities on Sociavis and in other Sociavis products.

                     How We Apply Our Content Policy: This provides information about the restrictions we may place on the use of Sociavis, including information about how we apply our content policies, procedures, measures, and tools.

                     Abuse Policy: For example, this policy explains how we may suspend access to Sociavis if we determine that you have often provided clearly illegal content, or suspend the processing of reports or complaints if we determine that you have often submitted manifestly unfounded reports or complaints. You can also learn more about how we handle repeated violations of our content policies here.

                     Complaint Handling Process: This provides information on the procedural rules of our internal complaint handling system.

                     Commercial Terms: These terms apply when you also access or use our Products for commercial or business purposes, including advertising, managing an app on our Platform, using our services for measurement, managing a group or Page for a business, or selling goods or services.

                     Community Payment Terms: These terms apply to payments made in or through Sociavis Products.

                     Commerce policies: These guidelines outline the policies that apply when you list products or services for sale on Sociavis.

                     Music Guidelines: These guidelines outline the policies that apply when you post or share content that contains music in Sociavis Products.

                     Advertising Policies: These policies apply to partners who advertise on the Sociavis Products and specify the types of advertising content allowed by partners who advertise on the Sociavis Products.

                     No Ads Terms: These Terms apply if you have a no ads subscription.

                     Self-Serve Ad Terms: These terms apply when you use the self-serve ad interfaces to create, submit, or deliver ads or other commercial or sponsored activity or content.

                     Sociavis Pages, Groups and Events Policy: These guidelines apply when you create or manage a Sociavis Page, group or event, or when you use Sociavis to communicate or manage a promotion.

                     Sociavis Platform Policies: These terms apply to the set of APIs, SDKs, tools, plug-ins, code, technology, content, and services that allow others to develop features, request data from Sociavis products, or provide us with data.

                     Developer Payment Terms: These terms apply to application developers using Sociavis Payments.

                     Sociavis Brand Resources: These guidelines outline the policies that govern the use of Sociavis trademarks, logos, and screenshots.

                     Recommendation Guidelines: The Sociavis Recommendation Guidelines and Instagram Recommendation Guidelines outline our guidelines for recommending and not recommending content.

                     System maps of our recommendation systems: This link contains information about the main parameters of our recommendation systems and options to customize your experience.

                     Live Policy: This policy applies to all content broadcast through Sociavis Live.

                     Terms for messaging services relevant to users in the EU and EEA: The terms for the chat, voice and video calling services included in Sociavis products can be found here and here in accordance with EU rules.
